Yesterday, the state Court of Appeals rejected the Columbus Monument Corporation\u2019s request to appeal a lower court\u2019s decision that tossed their attempts to block the removal of the statue.<\/p>\n\n\n\n

On Thursday, New York\u2019s highest court announced they would not hear the case. This decision means that the state\u2019s\u00a0Fourth Appellate Department\u2019s ruling<\/a>\u00a0that paved the way for the city to remove the statue will stand.<\/p>\n\n\n\n

Importantly, the appellate court did not rule on whether the city has the power to remove the statue. Instead, it found that the monument corporation\u2019s\u00a0<\/strong>lawsuit was filed prematurely because the decision to remove the statue had not gone through all the administrative steps needed for approval.<\/p>\n\n\n\n

Of course, had we not taken action early in the process, the monument might already have been destroyed. <\/p>\n\n\n\n

As soon as the City and Mayor Walsh follow the prescribed process necessary to destroy the historic Columbus Monument, we will be back in court. <\/p>\n\n\n\n
