This is our 90th Year. We aren’t going away

Yesterday, the state Court of Appeals rejected the Columbus Monument Corporation’s request to appeal a lower court’s decision that tossed their attempts to block the removal of the statue.

On Thursday, New York’s highest court announced they would not hear the case. This decision means that the state’s Fourth Appellate Department’s ruling that paved the way for the city to remove the statue will stand.

Importantly, the appellate court did not rule on whether the city has the power to remove the statue. Instead, it found that the monument corporation’s lawsuit was filed prematurely because the decision to remove the statue had not gone through all the administrative steps needed for approval.

Of course, had we not taken action early in the process, the monument might already have been destroyed.

As soon as the City and Mayor Walsh follow the prescribed process necessary to destroy the historic Columbus Monument, we will be back in court.
